This Disclaimer applies to all eggs, products, and information provided by Palumbo Eggs (“we,” “us,” or “our”) through the website palumboeggs.org and through any related sale or delivery of eggs to customers. Please read this Disclaimer carefully. By purchasing eggs from Palumbo Eggs, you acknowledge and accept every provision of this Disclaimer in full.
1. Eggs Are Sold “As Is”
All eggs sold by Palumbo Eggs are sold strictly on an “AS IS” and “WITH ALL FAULTS” basis. We make no warranties of any kind, whether express or implied, concerning the eggs, including without limitation:
- No warranty of merchantability;
- No warranty of fitness for a particular purpose;
- No warranty of suitability for any specific diet, health condition, or preparation method;
- No warranty regarding freshness, shelf life, nutritional content, taste, shell integrity, or yolk or white characteristics.
Because eggs are a natural product, their appearance and characteristics vary between hens, between seasons, and from day to day. Shell color, shell strength, yolk color, size, and other qualities may differ from store-bought eggs, and such variations are normal.
2. No Commercial Grading or Processing
Palumbo Eggs is a small, household-scale farm. We do not:
- Grade, wash, or process our eggs in a USDA-inspected facility;
- Operate under any commercial food-safety certification;
- Test eggs individually for pathogens, salmonella, or other contaminants;
- Offer the same industrial-scale safeguards used by commercial suppliers.
By purchasing our eggs, you acknowledge that you understand these limitations and you accept the eggs with full knowledge of them.
3. Food Safety Warning — Raw and Undercooked Eggs
The U.S. Food and Drug Administration (FDA) and U.S. Department of Agriculture (USDA) warn that eating raw or undercooked eggs may cause serious illness, including salmonella infection. Children, pregnant individuals, the elderly, people with compromised immune systems, and anyone with a medical condition affecting digestion should be especially cautious.
By purchasing our eggs, you acknowledge this risk and accept full responsibility for how you store, prepare, and consume our eggs.
4. Your Responsibility — Handling, Storage, and Cooking
Once eggs leave our possession, you are fully responsible for their handling, storage, and preparation. You agree to follow, at minimum, the following basic food-safety practices:
- Refrigerate the eggs immediately upon receipt at a temperature of 40°F (4°C) or below.
- Keep the eggs refrigerated continuously until you are ready to use them.
- Wash your hands, utensils, and surfaces thoroughly after handling raw eggs or shells.
- Cook eggs thoroughly before eating. Cook until both the yolks and the whites are firm.
- Do not consume eggs with cracked, leaking, or damaged shells.
- Do not consume eggs that have been left at room temperature for extended periods.
- Discard any egg that has an unusual smell, appearance, or texture.
Failure to follow safe food-handling practices can lead to foodborne illness. Palumbo Eggs is not responsible for any illness or injury resulting from improper storage, handling, or cooking.
5. Allergies
Eggs are a common allergen. If you or anyone who may consume our eggs has a known or suspected egg allergy — or any allergy, intolerance, or sensitivity — do not purchase or consume our eggs. Consult a qualified medical professional before introducing any new food, and read all packaging, prepared foods, and ingredient lists carefully. Palumbo Eggs is not responsible for any allergic reaction, anaphylaxis, or adverse health event of any kind.
6. No Medical or Nutritional Advice
Any information on palumboeggs.org or communicated by us is provided for general informational purposes only and is not intended as, and must not be relied upon as, medical, nutritional, dietary, or professional advice. We are a farm; we are not doctors, dietitians, nutritionists, or food scientists. Always consult a qualified professional before making dietary or health decisions.
7. No Guarantee of Shelf Life or Freshness After Delivery
Eggs are perishable. While we do our best to provide fresh eggs, we make no guarantees regarding shelf life, freshness, or quality after the eggs leave our possession. How long your eggs remain good to eat depends on storage, temperature, how they are transported, and many factors outside our control. You accept full responsibility for determining whether eggs are still safe to consume at the time of use. When in doubt, throw them out.
8. Assumption of Risk
Food and agriculture involve inherent risks that cannot be completely eliminated, including but not limited to the risk of foodborne illness, injury from handling raw products, and allergic reactions. By purchasing, accepting, or consuming eggs from Palumbo Eggs, you knowingly and voluntarily assume all such risks.
9. Waiver and Release of Claims
To the fullest extent permitted by law, by purchasing eggs from Palumbo Eggs, you waive, release, and forever discharge Palumbo Eggs, its owners, family members, employees, agents, and affiliates from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, and expenses (including attorneys’ fees), whether known or unknown, arising out of or in any way relating to:
- Illness, injury, allergic reaction, or adverse health event of any kind attributable to the consumption or handling of our eggs;
- Improper storage, handling, cooking, or consumption of our eggs;
- Spoilage, contamination, or quality issues after eggs leave our possession;
- Any failure, delay, cancellation, or non-delivery of an order;
- Any reliance on information provided on palumboeggs.org.
This waiver applies to you, your family, your heirs, your representatives, your household, and anyone else to whom you distribute or serve our eggs.
10. No Liability for Illness, Injury, or Allergic Reactions
Palumbo Eggs is not responsible for any illness, injury, allergic reaction, or other harm — to you, your family, your guests, or anyone else — that results from the consumption, handling, transportation, storage, or preparation of our eggs. Your purchase signals that you accept this risk and that you release us from liability accordingly.
11. Limitation of Liability
To the fullest extent permitted by law, in no event shall Palumbo Eggs or its owners, family members, employees, or agents be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation damages for personal injury, illness, medical expenses, emotional distress, lost wages, lost profits, or property damage — arising out of or related to the eggs, the Site, or any order, even if advised of the possibility of such damages.
Where liability cannot be excluded under applicable law, our total aggregate liability to you shall be limited to the amount you paid, if any, for the specific order giving rise to the claim.
12. Compliance with Local Laws
You are responsible for ensuring that purchasing and consuming farm-fresh eggs from a small producer is permitted under the laws of your jurisdiction. Palumbo Eggs makes no representation that our eggs are appropriate or available for use or consumption in any particular location.
13. Not for Resale
Unless we have agreed otherwise in writing, our eggs are sold for personal, household consumption only. They are not intended for commercial resale, use in a food-service establishment, or redistribution. If you wish to serve our eggs to guests, paying or otherwise, you do so entirely at your own risk, and this Disclaimer applies equally to them.
14. Relationship to Other Agreements
This Disclaimer is provided in addition to, and is incorporated into, our Terms & Conditions and our Privacy Policy. In the event of any conflict, the document most protective of Palumbo Eggs shall control to the fullest extent permitted by law.
15. Governing Law
This Disclaimer and any dispute arising from it are governed by the laws of the State of New York, without regard to conflict-of-laws principles. You agree that the exclusive venue and jurisdiction for any related dispute shall be the state or federal courts located in the State of New York.
16. Changes to This Disclaimer
We may update this Disclaimer at any time, at our sole discretion, without prior notice. The revised version will be posted on this page with an updated “Effective Date.” Your continued use of the Site or any new purchase of our eggs constitutes your acceptance of the updated Disclaimer.
17. Acknowledgment
By purchasing eggs from Palumbo Eggs, you acknowledge that you have read, understood, and agreed to this Disclaimer in full; that you are assuming all risks associated with purchasing, handling, and consuming farm-fresh eggs; and that you are releasing Palumbo Eggs from liability to the fullest extent permitted by law.
